    1. Acceptance and owner

    These Terms govern the use of RinoMONITOR, owned by Juan Facundo Couto Icasati, Argentine tax ID (CUIT) 20-25696841-0, domiciled at Otamendi 224, postal code C1405BRB, Autonomous City of Buenos Aires, Argentina. Contact: facundo.atmek@gmail.com.

    By accessing or using RinoMONITOR you accept these Terms and the Privacy Policy. If you do not agree, do not use the service.

    2. Nature of the service: a wellness tool

    RinoMONITOR is a wellness tool that alerts you in real time about your breathing and posture habits in front of the screen.

  • It is not a medical device. It does not diagnose, treat, cure, or prevent any disease or condition, and does not replace consultation, diagnosis, or treatment by a health professional.
  • Alerts are indicative. Detection can be affected by lighting, camera quality or position, the device, and other factors, and may contain errors.
  • If you have any discomfort or questions about your health, consult a health professional. In an emergency, contact your country's emergency services.

    • 3. Access and accounts

  • Registration is by invitation only. Professionals are invited by the administrator, and users by a professional.
  • Sign-in is done through links sent to your email.
  • Your account is personal and non-transferable.
  • You are responsible for keeping your email secure and for activity carried out from your account.
  • You must notify us immediately of any unauthorized use by writing to facundo.atmek@gmail.com.

    • 4. Minors

    People under 18 (or under the age of majority in their country, if higher) may only use RinoMONITOR with the authorization and supervision of their parent or legal guardian. The responsible adult accepts these Terms on the minor's behalf and is responsible for the minor's use of the service.

    5. Professional's obligations

    If you use RinoMONITOR as a professional, you agree to:

  • invite only people with whom you have a professional relationship and who have agreed to be invited (or, for minors, whose responsible adult has agreed);
  • use the data of the people you invited solely to support their use of RinoMONITOR, respecting professional confidentiality and applicable data protection rules;
  • safeguard the spreadsheets you export (Excel or Google Sheets), for which you become responsible;
  • not present RinoMONITOR information as a diagnosis or base health decisions on it;
  • not enter a person's profile data without their knowledge.

    • 6. Acceptable use

    You may not:

  • access or attempt to access other users' data;
  • breach the security of the service, reverse engineer it, or automate access;
  • use the camera to monitor other people without their consent;
  • enter false data or third-party data without authorization;
  • use the service for unlawful purposes.

    • 7. Test mode

    Test mode lets you use the monitor without storing session data. It requires signing in with a Google account, closes after 15 minutes of inactivity, and each access generates an email notification. See section 3.h of the Privacy Policy.

    8. Price and future plans

    RinoMONITOR is currently free. We may offer paid plans in the future, for users or for professionals. In that case:

  • we will inform you of the terms and prices at least 30 days in advance;
  • we will not charge you without your express acceptance;
  • plans for professionals may also be governed by specific commercial terms, which will be disclosed before any charge;
  • if you purchase a paid plan remotely as a consumer in Argentina, you may revoke your acceptance within 10 calendar days under Article 34 of Law No. 24,240; if you reside in another country, the withdrawal period granted by your law applies;
  • features available free of charge may change.

    • 9. Intellectual property

    The software, design, the RinoMONITOR brand, and the content of the service belong to its owner. We grant you a limited, personal, non-exclusive, non-transferable, and revocable license to use the service under these Terms.

    The data you enter remains yours and is processed under the Privacy Policy.

    10. Service availability

    RinoMONITOR is under development and is provided "as is" and "as available". We may modify, interrupt, or suspend features, in whole or in part, for maintenance, improvements, or technical reasons. Use requires a compatible browser and a working camera.

    11. Limitation of liability

    To the maximum extent permitted by applicable law, RinoMONITOR shall not be liable for:

  • health decisions made on the basis of the service's alerts or statistics;
  • interruptions or detection errors;
  • indirect damages arising from the use of or inability to use the service.

    • Nothing in these Terms limits the rights granted to you by Argentine Consumer Protection Law No. 24,240 or the consumer protection laws of your country of residence.

    12. Suspension and account deletion

  • You may request deletion of your account at any time by writing to facundo.atmek@gmail.com. Your data is deleted or anonymized as described in section 9 of the Privacy Policy.
  • We may suspend or cancel accounts that breach these Terms, notifying you where possible.

    • 13. Changes

    We may change these Terms. We will inform you of substantial changes, and the application may ask you to accept the new version to continue using it.

    14. Governing law and jurisdiction

    These Terms are governed by the laws of the Argentine Republic. Any dispute will be submitted to the competent courts, without prejudice to the rights granted to you by the consumer protection laws of your country of residence, including the right to bring proceedings before the courts of your domicile.
